The management of acquisition projects is the responsibility of Property Management Branch within Infrastructure Division.
Defence acquires property in accordance with the Lands Acquisition Act 1989 (LAA):
- Property may be acquired by the compulsory process, by agreement where the property is available in the market or by agreement where the property is not available in the market.
- Compulsory acquisition of real property must be approved by the Finance Minister or, as currently delegated, the Special Minister of State, and compensation is payable in such circumstances.
- Defence currently has LAA delegation to acquire real property, other than land in a public park, where the interest is available in the market.
- Defence does not have LAA delegation to acquire real property where the interest is not available in the market, the delegation resides with the Department of Finance and Deregulation.
