The Department of Defence is seeking feedback on proposed amendments to the Defence (Non-foreign work restricted individual) Determination 2024 (the Determination), part of the Safeguarding Australia’s Military Secrets (SAMS) legislative framework.
The SAMS framework helps protect sensitive Defence knowledge and capability by managing risks associated with the transfer of military expertise outside Australia.
As the strategic environment evolves, it is important that these settings remain contemporary and effective in safeguarding Australia’s national interests.
Review scope
The proposed updates will help ensure the Determination remains fit for purpose by clarifying how job family roles and time elapsed provisions apply to former Defence personnel, and by reflecting current workforce structures.
The amendments include:
- updating job role titles and classifications
- extending time elapsed periods for certain job family roles
- removing outdated and duplicate entries.
Consultation submission
Stakeholders are invited to review the consultation paper and provide feedback to help shape an effective and practical framework.
