Division 6: Removal on ceasing continuous full-time service

6.5.45 Purpose

This Division describes the benefits for a member who is removed on ceasing continuous full-time service, or in advance of ceasing.

Note: 'Ceasing continuous full-time service' includes all forms of discharge. This includes on retirement, retrenchment, and on completing a period of engagement. Note that Division 1 section 6.5.5 prevents some members who cease continuous full-time service from having a removal benefit.

Note: In the total workforce model, continuous full-time service may be described as service in Service category 6 or 7. A member who is in Service category 3, 4 or 5 and Service option C is also on continuous full-time service.

6.5.46 Removal on ceasing continuous full-time service

  1. This section applies to a member who is eligible for a removal on ceasing continuous full-time service.

  2. In this section ‘subsidised accommodation' means any of the following.

    1. A Service residence.

    2. Note: Section 1.3.73 defines a Service residence.

    3. Living-in accommodation.

    4. Accommodation for which rent allowance is payable.

  3. A member in a situation in an item in column A of the following table is eligible for a removal between the following locations, subject to the conditions and limits in column D of the same item.

    1. From the location in column B of the same item.

    2. To the location in column C of same item.

    1. The member is to relocate from subsidised accommodation to another home in the same location. The subsidised accommodation.

    A home within the same location as the subsidised accommodation.

    Note: The member's belongings may be removed to storage and then to their home under section 6.5.60.

    The member must have occupied subsidised accommodation immediately before ceasing continuous full-time service.

    2. The member is to relocate to a location within Australia that is not in the posting location they last received a removal. The posting location the member last received a removal to

    A location in Australia chosen by the member.

    Note: The member’s belongings may be removed to storage and then to their home under section 6.5.60.

    The location cannot be within the same posting location the member last received a removal to unless they meet the condition in table item 1.
    3. The member is to relocate overseas. The posting location the member last received a removal to. The Australian capital city that is the nearest port of exit to the overseas location the member has chosen to live. The items must be received by the member’s overseas removal agent.
    4. The member is a member of the Reserves on continuous full-time service, appointed or enlisted in Australia. The posting location the member last received a removal to. A location chosen by the member subject to the limit in column C.

    The maximum benefit payable is the lesser of the following.

    1. The cost of the removal.

    2. The cost of a removal to the location the member lived immediately before they began continuous full-time service.

    5. The member is a member of the Reserves on continuous full-time service, and was appointed or enlisted from an overseas country. The posting location the member last received a removal to. A location chosen by the member subject to the limit in column C. The maximum benefit payable is the lesser of the following.
    1. The cost of the removal.

    2. The cost of a removal to the member's overseas removal agent at the member's port of entry to Australia.

  5. A member in a situation in an item in column A of the following table is eligible for a removal to be provided at a time in column B of the same item and subject to the conditions in column C of the same item.

    Conditions

    1. The member requests to be removed before ceasing continuous full-time service and table item 2 does not apply. Any time during the final 12 months of the member's continuous full-time service. The member must have received a discharge authority.
    2. The member requests to be removed before ceasing continuous full-time service for compassionate reasons. Any time before ceasing continuous full-time service.

    The CDF has approved a removal after being satisfied at least one of the following apply.

    1. The removal is required as a result of a dependant’s illness that is confirmed by a medical practitioner.

    2. Suitable accommodation is not available in the member’s current posting location.

    3. Suitable secondary or higher education for the member’s child is not available in their current posting location.
    4. There are other exceptional reasons that require the member to move.

    5. Note:The member must provide relevant documents to the CDF.

    3. The member has ceased continuous full-time service. Up to 24 months from the day of ceasing or a later day the CDF considers is reasonable. The CDF must consider the member’s circumstances when deciding to extend the period under column B.
  6. This subsection applies to a member who does not complete their service at the time notified in the discharge authority, and who continues to serve. The member must pay to the Commonwealth any amount they received for the removal. This does not apply if the removal coincides with a posting during the final 12 months of service.

6.5.47 Removal if service continues after intended date of ceasing

  1. A member may have had a removal in advance of ceasing continuous full-time service, but they continue to serve beyond the date notified in their discharge authority.

  2. On their next posting, the member is eligible for a removal at Commonwealth expense. It is limited to the cost of a removal from a. to b. below.

    1. The location they were posted to immediately before the removal in advance of ceasing continuous full-time service.

    2. The new posting location.

    Example: A member posted in Melbourne is removed to Perth in advance of ceasing. The member continues to serve past their expected date of ceasing. They are then posted to Sydney. They are eligible for a removal only to the value of a removal from Melbourne to Sydney.

  3. ...

  4. The limit on the benefit under subsection 2 does not apply in either of these cases.

    1. Both the following conditions are met.

      1. The member was granted a compassionate removal to a personal location where benefits are provided.

      2. The Commonwealth did not place cost limits on the removal.

    2. The removal in advance of ceasing continuous full-time service corresponds with a regular removal on posting during the final 12 months of the member's service.

6.5.48 Removal on ceasing continuous full-time service at own request

  1. A member who ceases continuous full-time service at their own request is eligible for a removal to one of the locations in the table in Division 6 section 6.5.46. To qualify, they must meet the relevant conditions in this table.

    2. an officer on a fixed tenure appointment.
    Note: 'Other rank' members are listed in DFRT Determination No. 2 of 2017, Salaries, Part A Division 1 section A.1.9, General (definitions)
    they must have completed one of these periods.
    1. Their initial period of engagement or appointment.
    2. Six years' continuous full-time service.
    2. an officer on an indefinite appointment they must have completed, in total, six years' continuous full-time service.
  2. The member might not meet the conditions in the table in subsection 1 above. In this case, the CDF may still approve a removal if satisfied that the member meets all of these conditions.

    1. There are compassionate reasons for ceasing continuous full-time service that cannot be resolved by any other means.

    2. The compassionate reasons are beyond the member's control.

    3. The circumstances leading to the request to cease continuous full-time service have come about since the member enlisted or was appointed, or have seriously worsened since that time.

  3. For a member with less than three years' continuous full-time service who is offered a removal under subsection 2, the Commonwealth subsidy for a removal is limited. It covers only the cost of a removal to one of these places.

    1. The member's place of enlistment.

    2. For an overseas applicant, the port of entry to Australia.

6.5.49 Removal of a vehicle on ceasing continuous full-time service

A member's eligibility for the removal of a vehicle on ceasing continuous full-time service is the same as for removal of a vehicle on posting. This includes removal of a towable item or a recreational or hobby vehicle.
