Not so fine straight from our pay

Defence Pay will release money from 300 ADF members pay accounts due to fines owed to the NSW RTA.

The debts ranging from $150-$3000, relate to all three services, however, the majority were Army members.

For large fines, arrangements will be made by DEFPAC with the NSW Debt Recovery Office to recover the amount over a numbers of pays.

The debts are being recovered under Section 120B of the Defence Act and are being presented to DEFPAC with a certified copy of the Judgement and a Statutory Declaration or Affidavit confirming the debt is outstanding.

Unit CO/OC’s and members will be advised by DEFPAC in writing, advising them of the recovery action.

The majority are traffic fines that relate to the driving of military vehicles where the driver has been identified.

DNSDC identified the unit, which has been allocated the military vehicle under Section 14.11 of the Privacy Act 1988.

DEFPAC has looked after the interest of the members by negotiating the recovery of the debt over a number of pay periods and advises each member in writing of the recovery action.

It is anticipated that all other States and Territories will follow the lead of NSW and recover outstanding fines of Army members through DEFPAC.

The NSW Debt Recovery Office can apply the same approach to APS personnel.
