Investigation nears ends

A SOLDIER has been charged with misconduct as a result an investigation into allegations that SASR committed war crimes during INTERFET in 1999.

CA Lt-Gen Peter Leahy recently said the investigation were nearing completion.

Lt-Gen Leahy said he could confirm that one serviceman had been charged with misconduct with regard to corpses “in that he kicked a body”.

“Because of the nature of his service he cannot be named at this time,” he said.

The investigation team had conducted extensive investigation in Australia, New Zealand, United Kingdom and East Timor and taken comprehensive legal advice.

He said a statement on the results of the investigations will be made upon completion of the process consistent with security, privacy and judicial requirements.

“It would also be inappropriate to comment or speculate on the results of this disciplinary action. This matter is still sub-judice and to make any comment at this time could prejudice the hearings.”

“I have every confidence in the ability of the military justice system to deal with this matter.”

Lt-Gen Leahy said in no way should these allegations of misconduct undermine or devalue the work of the men and women who have served, and continue to serve, in East Timor.
