Disposal Step 3a – Dispose of the property on the Open Market

Activity

Considerations

Outcomes of all activites

1) Confirm property is available for disposal and review disposal strategy as required.

  • Update property valuation (if required).
  • Risk assessment.
  • Disposal strategy and contract conditions agreed by Finance and Housing (as required).
  • Disposal of property using one of the following techniques:
    • Tender
    • Auction
    • Private treaty sale
  • Updated property valuation.
  • LAA approval.
  • Contracts exchanged.

 

 

2) Obtain LAA approval from Department of Finance and Deregulation.

 

3) Determine method of sale (Tender; Auction; Private Treaty) and prepare appropriate documentation.

  • Tender evaluation plan; reserve price; Departmental representatives.
  • Marketing agent’s advice.

4) Prepare - Contract of Sale and Standard Tender Conditions.

  • Standard Defence contract of sale (include and special contract conditions set by FaHCSIA)
  • Special conditions
  • Legal advice
  • Probity advisor
  • Property valuation and acceptable price (Value for Money)
5) Marketing Agent advertises the disposal of the property.
  • Distribution of due diligence material.
6) Register the disposal on AusTender.
  • Commonwealth Procurement Guidelines.
7) Conduct disposal in accordance with approved method of sale.
  • Tender; Auction; private Treaty.
8) Evaluate offers.
  • Approved method of disposal and associated documentation.
9) Advise proponents as necessary.
  • Details are generally treated as Commercial in Confidence until after settlement.
10) Contract Exchange
  • Ensure special conditions from Finance and Housing are included.
11 Complete and distribute disposal notification (day of sale).
  • Notification template for the termination of services, maintenance contracts etc.
12 Complete the disposal – proceed to Disposal Step 4.
  • Disposal Step 4.
