Division 15: Submarine service allowance

Commencement

1.

This Determination commences on the date of signature.

Note: This Determination was signed on 4 June 2008.

Repeal and Transition

2.1

Determination No. 9 of 1995, Submarine Service Allowance, is repealed.

2.2

A person who was eligible for a benefit under the repealed determination is taken to be eligible for the corresponding benefit under this Determination.

2.3

An exercise of administrative discretion under the repealed determination is taken to have been an exercise of the corresponding discretion under this Determination.

Purpose

This Determination creates a disability allowance to recognise the special nature of work performed in or in support of a seagoing submarine.

Definitions

4.

This table defines terms used in this Determination.

 

Term

Definition

cumulative sea service

Has the same meaning as that term in DFRT Determination No. 1 of 1996, Seagoing Allowance.

sea day

seagoing submarine

Means:

(a)  a submarine in commission in the service of the Royal Australian Navy; or

(b)  a submarine under Australian or foreign government control, that is approved in writing by the Chief of the Defence Force as a seagoing submarine for the purposes of this Determination.

Submarine Arm

Means:

(a)  the Royal Australian Navy Submarine Arm; or

(b)  the Submarine Arm of any Commonwealth or foreign government approved in writing by the Chief of the Defence Force.

Submarine Sea Training Group

Means:

(a)  the submarine Sea Training Group of the Royal Australian Navy; or

(b)  a comparable overseas submarine sea training organisation approved in writing by the Chief of the Defence Force for the purposes of this Determination.

In this Determination, a reference to the Chief of the Defence Force (CDF) includes a reference to a person the CDF has authorised to exercise administrative powers vested in the CDF under this Determination.

Application

6.

A member to whom salary is payable who is below the rank of Rear Admiral in the Navy or who is a Medical or Dental Officer below the rank of Commander in the Navy will be paid Submarine Service Allowance when:

 

(a)

the member is posted to a seagoing submarine; or

 

(b)

the member is posted to a shore establishment for service in a seagoing submarine; or

 

(c)

the CDF is satisfied that the member is liable to undertake at least 100 sea days a year while posted as a member of a Submarine Sea Training Group; or

 

(d)

the member is undertaking training in a sea going submarine to become a qualified submariner.

Rate of allowance

7.1

A member to whom paragraph 6 (a), (b) or (c) applies will receive Submarine Service Allowance according to the following table:

7.2

A member to whom paragraph 6 (d) applies will receive Submarine Service Allowance, until the end of the period of training, at the higher of:

 

(a)

the minimum rate that would be payable under subclause 7.1 above; or

 

(b)

the rate of Seagoing Allowance (if any) which the member received before beginning the period of training.

Other allowances

Determination No. 4 of 2008, Allowance for Specialist Operations, and Determination No. 5 of 2008, Special Forces Disability Allowance, prescribe whether a member receiving either of those allowances may also be paid Submarine Service Allowance.

Working out fortnightly and daily rates

9.1

Annual rates of Submarine Service Allowance are payable on a fortnightly basis.

9.2

Where any payment is made to a member fortnightly, the fortnightly rate of payment is to be calculated in accordance with the following formula:

 

(A x 14) ÷ 365

where A is the annual rate of payment.

9.3

The daily rate of an annual payment is one fourteenth part of the fortnightly rate of payment.
