Division 10: Paratrooper allowance

Purpose

G4.65

Paratrooper allowance is paid in recognition of the stresses, hazards and skills associated with parachuting, and attraction and retention factors which are not comprehended within the salary structure.

Commencement

1.

This Determination commences on 1 February 2001.

Definitions

2.

In this Determination:

 

“CDF” means the Chief of the Defence Force, and includes a reference to another person that the CDF authorises for the purpose of the provision in which the reference occurs;

 

“decompression illness” means the illness caused by gases, which have been dissolved under pressure in the bloodstream, returning to their natural state;

 

“free fall instructor” means a member who is qualified to undertake the duties of a free fall instructor;

 

“free fall paratrooper” means a member who has the qualifications required to be held by a free fall paratrooper in the Navy, the Army or the Air Force, as applicable;

 

“HAPO” means a high altitude parachute operation from a height greater than 12,000 feet above mean sea level (whether in the atmosphere or in a recompression chamber);

 

“parachute jump instructor” means a member who is qualified to undertake the duties of a parachute jump instructor;

 

“parachute jump master” means a member who is qualified to undertake the duties of a parachute jump master;

 

“paratrooper” means a member who has the qualifications required to be held by a parachutist in the Navy, Army or Air Force, as the case requires;

 

“part-time leave without pay” has the meaning given by clause 20 of Determination No. 6 of 1992, Salaries;

 

“tactical parachute operation” means a parachute descent from an aircraft under actual or simulated combat conditions;

 

therapeutic treatment” means treatment provided to prevent or alleviate the symptoms of decompression illness.

Paratrooper Allowance – member on continuous full-time service

3.

A member who is a paratrooper rendering continuous full-time service is entitled to Paratrooper Allowance at the rate that applies to them in the table.

Allowance payable after completion of certain service

4.1A

In this clause, “qualified” means holding the required Free Fall Instructor or Parachute Jump Instructor qualification. It does not mean meeting the recent parachuting experience requirement set out in subclause 6.2.

4.1

In spite of subclause 6.2, a member who:

 

(a)

is a Free Fall Instructor or a Parachute Jump Instructor; and

 

(b)

is not posted to a parachute unit or group,

 

is entitled, for the period of 3 years beginning on the day on which the member ceases to be posted to a parachute unit or group, to Paratrooper Allowance at the rate of:

 

(c)

for a Free Fall Instructor — $2,100 a year; and

 

(d)

for a Parachute Jump Instructor — $1,679 a year.

4.2

A member is not entitled to an allowance under subclause 4.1, if the member:

 

(a)

is entitled to Paratrooper Allowance under clause 3;

 

(b)

is not qualified and liable to perform the duties of a Parachute Jump Instructor or Free Fall Instructor; or

 

(c)

is excluded permanently from service which would qualify for payment of the allowance by reason of incapacity or otherwise.

4.3

At the end of the period of eligibility referred to in subclause 4.1, the CDF may extend the period by a further period that is reasonable in the circumstances if, as a result of:

 

(a)

the exigencies of the Service;

 

(b)

an illness or injury of the member; or

 

(c)

the member’s family obligations,

 

the member is unable to return to service in a parachute unit or group.

 

Persons who can make the decision under subclause 4.3 on behalf of the CDF:

Commanding Officer or Officer Commanding, not below MAJ(E), in the member's direct chain of command

Army formation Commander of a unit designated as a parachute unit by the Chief of Army

 

Paratrooper Allowance – member of the Reserve Forces

5.

A member of the Reserve Forces who is a paratrooper is entitled to Paratrooper Allowance, for each day or part of a day the member renders Reserve service, at the rate that applies to them in the table.

Additional allowance for HAPO descent

5A.1

This clause applies to a member who is a paratrooper and who:

 

(a)

completes a HAPO descent; or

 

(b)

if the member does not complete a HAPO descent — is required to use, and uses, supplementary oxygen in the course of a HAPO; or

 

(c)

is responsible for management of the oxygen distribution console within the aircraft for the members involved in a HAPO.

5A.2

The member is entitled to an additional amount of Paratrooper Allowance of:

 

(a)

for a member to whom paragraph 5A.1(a) applies — $307.92; and

 

(b)

otherwise — $153.95.

5A.3

If the member has an entitlement to more than 1 amount under subclause 5A.2 on a day, the member is entitled to 1 amount only on that day, being (if applicable) the higher amount.

Allowance not payable

6.1

A member is not entitled to more than 1 rate of Paratrooper Allowance at any time.

6.2

A member is not entitled to an annual rate of Paratrooper Allowance during a period beginning more than 6 months after the day on which the member last made a parachute descent, unless the CDF approves payment during the period.

 

Persons who can make the decision under subclause 6.2 on behalf of the CDF:

Commanding Officer or Officer Commanding, not below MAJ(E), in the member's direct chain of command

Army formation Commander of a unit designated as a parachute unit by the Chief of Army

 

6.3

For subclause 6.2, the CDF must have regard to:

 

(a)

the degree of illness or infirmity, if any, of the member which prevented the member from making a parachute descent;

 

(b)

whether the illness or infirmity was caused by the member’s own fault;

 

(c)

the opportunity the member had to make a parachute descent during the period following the day on which the member last made a parachute descent; and

 

(d)

any other reason preventing the member from making a parachute descent.

6.4

Determination No. 4 of 2008, Allowance for Specialist Operations (Column 5 of Schedules 1 and 2) and Determination No. 5 of 2008, Special Forces Disability Allowance (Column 6 of Schedule 1), prescribe whether a member receiving either of those allowances may also be paid Paratrooper Allowance.

Fortnightly and daily rates

7.11

If a payment of an annual rate of Paratrooper Allowance is made to a member fortnightly, the fortnightly rate of payment must be worked out using the formula:

The daily rate is the fortnightly rate divided by:

 

(a)

for a member who is granted part-time leave without pay — 10; and

 

(b)

otherwise — 14.
