3.5.58   Purpose

 

This Division provides a completion bonus for some officers with certain qualifications in the Navy. The payment is designed to encourage members to stay in the Seaman specialisation and to assist them to gain further qualifications.

3.5.59   Completion bonuses

 

This Division provides for two different types of completion bonuses.

 

a.

A bonus after each 12 months of service.

3.5.60   Definitions

1.

A reference to a Bridge Warfare Certificate is taken to include a reference to a Bridge Watchkeeping Certificate.

2.

In this Division, effective service means service that meets all these conditions.

 

a.

It is continuous full-time service.

 

b.

It is paid.

Exception: Unpaid leave of less than 21 calendar days.

 

c.

It is not excluded as ineffective service by subclause 3.

3.5.61   Members this Division applies to

 1.

This Division applies to members who meet both these conditions.

 

a.

They hold one of these ranks within the Seaman specialisation.

 

i.

Lieutenant.

 

ii.

Lieutenant Commander.

 

b.

They hold a Bridge Warfare Certificate (BWC).

 2.

This Division ceases to apply on 31 August 2007.

3.5.62   Members this Division does not apply to

 

This Division does not apply to a member who meets either of these conditions.

 

a.

The member has transferred out of the Seaman specialisation.

 

b.

The CDF considers the member is no longer liable to serve as a Seaman officer.

3.5.62A  Amounts of annual completion bonus

 

This table shows the amounts of completion bonus that a member may receive under this Division based on their rank and qualifications.

For a member in the Navy, charge qualified means that the member meets all of these conditions.

a.

The member has been selected by the Minor Command and Sea Charge Advisory Committee.

b.

The member has successfully completed the Commanding Officer /Executive Officer Designate Course.

c.

The member is or has been posted to one of the following positions.

 

i.

Executive Officer of a major fleet unit.

 

ii.

Commanding Officer of a minor war vessel.

 

iii.

Commanding Officer of a clearance diving team.

 

iv.

Commanding Officer of Laser Airborne Depth Sounder.

3.5.63   Annual completion bonus – member in bonus scheme on 1 April 2006

1.

This clause applies to a member this Division applied to on 1 April 2006.

2.

The member is entitled to a completion bonus on 1 April 2007.

Exception: A member who stops being a member this Division applies to may only be paid a pro rata amount.

The member is entitled to a pro-rata completion bonus for the period 1 April 2007 to 31 August 2007.

3.

The bonus is calculated using the method in clause 3.5.66.

3.5.64   Annual completion bonus – member joins bonus scheme after 1 April 2006

1.

This clause applies to a member who this Division first applied to after 1 April 2006.

2.

The member is entitled to a completion bonus on each anniversary of the day this Division first applied to the member.

Exceptions:
1. The member cannot serve for the purpose of the bonus after 31 August 2007.
2. A member who stops being a member this Division applies to is not entitled to any further payments under this clause.

3.

The bonus is calculated using the method in clause 3.5.66.

3.5.65   Completion bonus when member leaves the scheme

1.

This clause applies if any of the following events happen.

 

a.

The member dies.

 

b.

The member is promoted to the rank of Commander.

 

c.

The member ceases service at the end of a fixed term (or fixed tenure) appointment.

 

d.

The member retires due to reaching compulsory retirement age.

 

e.

The member's service is terminated due to physical or mental incapacity that is not within the member's power to control.

This clause also applies to a member participating in the scheme on 31 August 2007, the day it ceases.

2.

This clause does not apply if a member ceases continuous full-time service in circumstances not described in subclause 1.

3.

A member to whom this clause applies is entitled to a completion bonus.

Note: If a member has died, payment may be made to the member's legal personal representative.

4.

The bonus is calculated using the method in clause 3.5.66.

3.5.66   Calculation of the bonus amount

1.

This clause shows how to calculate an amount of completion bonus that a member is entitled to under this Division.

2.

This table shows the first stage of calculating the amount of a member's completion bonus.

Work out the number of calendar days in a period with the following start and end dates.

a.

The period starts on the later of these dates.

 

i.

1 April 2006.

 

ii.

The day this Division first applied to the member.

 

iii.

The day the member was last entitled to a completion bonus under this Division.

b.

The period ends on the day before the date the member becomes entitled to the completion bonus.

 

Example: A Lieutenant Commander was entitled to a bonus on 1 September. On

1 October the member is promoted to Commander, and is entitled to a bonus under clause 3.5.65. There are 30 calendar days in the period.

In the period in Step 1, did the member work in more than one of the items in the table in clause 3.5.62A?

3.

If the answer to Step 2 is 'no', subclause 3 provides the rest of the process for calculating the amount of a member's completion bonus.

 

If the answer to Step 2 is 'yes', subclause 4 provides the rest of the process for calculating the amount of a member's completion bonus.

 

3.

This table shows the second stage of calculating the amount of a member's completion bonus. It applies where the answer to Step 2 of the table in subclause 2 is no.

Subtract the number of calendar days of ineffective service in the period.

5.

Divide the outcome of Step 4 by 365.

 

If the period includes 29 February, substitute 366 for 365.

6.

Find the completion bonus rate that corresponds to the member's rank and qualifications.

7.

Multiply the outcomes of Step 5 and Step 6. Convert this to a number, in dollars and cents, rounded to the nearest cent.

8.

The member may be paid the outcome of Step 7.

 

4.

This table shows the second stage of calculating the amount of a member's completion bonus. It applies where the answer to Step 2 of the table in subclause 2 is yes.

Work out how many calendar days there were in each period that the member worked at Items 1, 2 or 3 in the table in subclause 5.

 

Example: A Lieutenant Commander Principal Warfare Officer becomes charge qualified 50 calendar days before the end of the period in Step 1 of the table in subclause 2. For that member, the period is divided as follows:

a.

315 days at Item 2 of the table at clause 3.5.62A.

b.

50 days at Item 3 of the table at clause 3.5.62A.

5.

Subtract the number of calendar days of ineffective service from the period in which it fell.

 

6.

Divide the outcome of each period in Step 5 by 365.

 

If one of the periods includes 29 February, divide each period in Step 5 by 366.

7.

Find the completion bonus rate that corresponds to each rank and qualification the member held during the period in Step 1.

8.

Multiply each outcome of Step 6 by the corresponding completion bonus rate determined in Step 7.

9.

Add the results of each calculation in Step 8.

10.

The member may be paid the outcome of Step 9.

3.5.67   Payment

1.

A member may nominate payment details for the completion bonus, subject to these conditions.

a.

The form must be completed before the day the completion bonus is due.

 

b.

The nomination must be on the form at Annex 3.5.I.

2.

If a member does not nominate payment details the entitlement is to be paid into the member's normal pay account.
