|
This Division provides a retention bonus for members of the Air Force in prescribed ranks within the Air Traffic Control employment category. The payment is designed to encourage members with specialist qualifications to stay in the Permanent Air Force. |
|
|
This Division applies to a member if all of the following conditions apply to them. |
||
|
|
a. |
The member met all of the following conditions on a day between 1 September 2008 and 26 September 2008. |
|
|
|
i. |
The member was serving in the Permanent Air Force. |
|
|
|
ii. |
The member was entitled to salary in the Air Traffic Control employment category. |
|
|
|
iii. |
The member had completed an initial minimum period of service. Note: This concept is defined in a determination made by the Chief of Air Force under sub-regulations 53(1), 58(7), 58(9), 90(6), 90(7) and 97(6) of the Defence (Personnel) Regulations 2002. |
iv. |
The member was not on a return of service obligation. Note: This concept is defined in a determination made by the Chief of Air Force under sub-regulations 53(1), 58(6), 62(6), 90(5), 94(8) and 97(5) of the Defence (Personnel) Regulations 2002. |
v. |
The member held a substantive rank of Flying Officer, Flight Lieutenant or Squadron Leader. |
|
|
|
|
Note: The member remains eligible to continue in the scheme if they are promoted to Wing Commander after their acceptance. See: Clause 3.5.326, Member promoted after receiving a bonus payment |
|
|
|
b. |
The member has received one of the following proficiencies. |
|
|
|
i. |
A Tower Supervisor. |
|
|
|
ii. |
An Approach Supervisor. |
|
|
|
iii. |
An Air Traffic Control Instructor. |
|
|
|
c. |
The member agrees to provide one year of effective service in the Air Traffic Control employment category. The member must use the form at Part B to Annex 3.5.ZI. See: Annex 3.5.ZI, Air Force – Air Traffic Control retention bonus scheme |
|
|
|
This Division does not apply to a member in any of the following circumstances. |
||
|
|
a. |
The member first met the conditions under paragraphs 3.5.320.a – 3.5.320.b after 26 September 2008. |
|
|
|
b. |
The member has been notified of their selection for a provisional or substantive promotion to the rank of Wing Commander. |
|
|
|
c. |
The member has less than one year to serve until the end of the following periods. |
|
|
|
i. |
The member's fixed period of service. |
|
|
|
|
Exception: The Chief of Air Force has accepted the member's application to have their fixed period of service extended to cover the period of service required for the bonus. |
|
|
|
ii. |
The member's compulsory retirement age. |
|
|
|
|
Exception: The Chief of Air Force has accepted the member's application to have their retirement date extended to cover the period of service required for the bonus. |
|
|
1. |
The Director Personnel – Air Force may offer a retention bonus of $30,000 to an eligible member. |
|
2. |
The offer must be made using the form at Part A to Annex 3.5.ZI. |
|
|

1. |
An eligible member may accept a bonus under this Division any time after they receive an offer, until the latest of the following dates. |
|
|
|
a. |
Twenty-eight days after the day the offer is made. |
|
|
b. |
If the member was deployed when the offer under paragraph a. was made — the day 28 days after the day the member returns to Australia after a deployment. |
|
|
c. |
A longer period that the Director General Personnel – Air Force decides is reasonable, having regard to the member's circumstances. |
|
2. |
An acceptance made under this subclause must be on the acceptance form at Part B to Annex 3.5.ZI. |
|
|
|

3. |
The acceptance must include an undertaking to serve for one year in the Air Traffic Control employment category (this is called the agreed period of service). |
|
|
4. |
The member must attach a certified copy of their Air Traffic Control Record of Training and Proficiency form with their acceptance. See: Form PH112, Air Traffic Control Record of Training and Proficiency |
|
|
1. |
The member's agreed period of service must be served as effective service. |
|
|
2. |
For the purpose of this Division, effective service means service that meets all these conditions. |
|
|
|
a. |
It is continuous full time service. |
|
|
b. |
It is paid. Exception: Unpaid leave of less than 21 calendar days. |
|
|
c. |
It is counted as a period of effective service under subclause 3. |
|
3. |
This table lists a range of leave types and activities and sets out how a period of that leave or activity counts toward member's period of effective service. |

An undertaking for further service under Part 8 of the Military Superannuation and Benefits Act 1991, as preserved by item 4 of Schedule 4 Defence Legislation Amendment Act (No. 1) 2005. |

|
9. |
A period when the member is discharging a return of service obligation or another undertaking for further service. |
|
1. |
The retention bonus is payable to an eligible member on receipt of the member's completed acceptance form. |
|
2. |
A member who joins the scheme must serve in the Air Traffic Control employment category until they complete one year of effective service. |
|
3. |
A member who is offered a bonus is taken to have commenced their agreed period of service on the first day on or after 1 September 2008 that the member met the conditions under paragraph 3.5.320.1.a. |
|
|

|
1. |
This clause applies to a member who meets both of the following conditions. |
|
|
|
a. |
The member receives a bonus under this Division. |
|
|
b. |
The member is subsequently promoted to provisional or substantive rank of Wing Commander. |
|
2. |
The member remains eligible to continue in the scheme. |
|
|
3. |
The member must continue to complete their agreed period of service in the Air Traffic Control employment category. |
|
|
1. |
If a member fails to complete their agreed period of service under this Division for any of the following reasons, they are not required to repay any part of the retention bonus. |
|
|
|
a. |
The Director General Personnel – Air Force determines that the member's reason for ceasing to serve in the Air Force is beyond the member's control. Example: The member is terminated because of medical unfitness, or dies. |
|
|
b. |
The member transfers from the Permanent Force to the Reserves at Air Force's initiative. Authority: Chapter 8 Part 2 Division 2 or 3 of the Defence (Personnel) Regulations 2002. |
|
2. |
A member will be required to repay the full amount of the retention bonus if they fail to complete their agreed period of service for any of the following reasons. |
|
|
|
a. |
The member voluntarily leaves the employment category for which the bonus was offered. |
|
|
b. |
The member voluntarily transfers out of the Air Force. |
|
|
c. |
The member voluntarily transfers to the Reserves. |
|
|
d. |
The member voluntarily applies to terminate service in the Permanent Force. |
|
|
e. |
The member's service is terminated for performance or disciplinary reasons. |
|
1. |
A member may nominate payment details for the retention bonus, subject to these conditions. |
|
|
|
a. |
The form must be completed before the day the payment is due. |
|
|
b. |
The nomination must be on the form at Annex 3.5.ZI. See: Parts C and D of Annex 3.5.ZI, Air Force – Air Traffic Control retention bonus scheme |
|
2. |
If a member does not nominate payment details in the form at Annex 3.5.ZI, the retention bonus may only be paid into the member's normal pay account. |
