3.5.128  Purpose

 

This Division provides an obligation payment and a completion bonus for Aircrew officers and sailors in the Navy. The payment is designed to encourage members to continue to serve in the Navy as Aircrew specialists.

3.5.129  Payments under this Division

 

This Division provides for four different types of payment.

 

a.

An obligation payment, paid on joining the scheme.

b.

A completion bonus, paid to members who remain in the scheme for the number of years the member agrees to serve.

c.

A pro rata completion bonus, paid to members who remain in the scheme for fewer than the number of years the member agrees to serve, in prescribed circumstances.

1.         

d.

Up to four six-monthly payments, paid to some Navy members who meet certain eligibility conditions.

3.5.130  Definitions

1.

For the purpose of this Division, effective service means service that meets all these conditions.

 

a.

It is continuous full time service.

 

b.

It is paid.

Exception: Unpaid leave of less than 21 calendar days.

 

c.

It is not ineffective service under subclause 2.

2.

This table lists a range of leave types and activities and sets out how a period of that leave or activity counts toward member's period of effective service.

Leave at half pay

Example: Long service leave at half pay.

 

Half the period of the leave counts as effective service.

 

 

8.

An undertaking for further service under Part 8 of the Military Superannuation and Benefits Act 1991, as preserved by item 4 of Schedule 4 Defence Legislation Amendment Act (No. 1) 2005.

 

The whole period does not count as effective service.

 

9.

A period when the member was discharging another undertaking for further service.

Exception: An undertaking for further service associated with a promotion.

 

 

10.

Return of service obligations

 

A period when the member is discharging a return of service obligation associated with the following.

 

a. An overseas posting.

 

b. Professional or trade training that is directly relevant to the member's occupation, and not described in item 11.a of this table.

 

Both of these periods are effective service.

i.

The period of the overseas posting or the training.

 

ii.

The period of the return of service obligation.

 

 

11.

Return of service obligations

 

 

 

A period when the member is discharging a return of service obligation associated with the following.

 

a. A period of initial category training.

Example: Initial Aircrewman category training

 

b. A period of primary qualification training.

Example: Pilot or Observer course

 

c. Professional or trade training provided on transfer from the Army or Air Force.

 

d. Professional or trade training provided on recruitment from another country.

 

e. Any other return of service obligation not described in

item 10 or 11 of this table.

The whole period does not count as effective service.

 

 

3.

For the purpose of this Division, service period means either of the following.

 

a.

The period the member elects to serve in this scheme, under clause 3.5.134.

b.

The period the member is to serve in the scheme, determined under clause 3.5.133.

4.

For the purpose of this Division, an Aircrewman officer is a member who meets all of the following conditions.

 

a.

The member was formerly entitled to salary for an Aircrewman employment category, mentioned in Schedule B.11 Part 1 of DFRT Determination No. 15 of 2008, Salaries.

 

b.

The member is an officer.

 

c.

The member has kept their Aircrewman title as a specialisation.

3.5.131  Members this Division applies to

1.

A member who meets all the following conditions is eligible to apply for bonuses under this Division.

 

a.

They have completed the initial minimum period of service (IMPS).

Note: This concept is defined in Determination 12A, made by the Chief of Navy under sub-regulations 90(6), 90(7), 91(2), 97(3), 97(6) and 98(2) of the Defence (Personnel) Regulations 2002.

b.

They hold any of the following ranks.

 

i.

Leading Seaman.

 

ii.

Petty Officer.

 

iii.

Chief Petty Officer.

 

iv.

Warrant Officer.

 

v.

Sub Lieutenant.

 

vi.

Lieutenant.

 

vii.

Lieutenant Commander.

 

Note: The member must hold the rank as a substantive rank.

 

c.

They meet any of the following requirements.

 

i.

The member is entitled to salary for an Aircrewman employment category mentioned in Schedule B.11 Part 1 of DFRT Determination No. 15 of 2008, Salaries.

 

ii.

The member holds a Pilot primary qualification.

 

iii.

The member holds an Maritime Aviation Warfare Officer.

 

d.

The member is liable to fly.

 

 

Authority: In this paragraph, liable to fly has the same meaning as in subclause 6.2 of DFRT Determination No. 13 of 2008, Flying and flight duties allowance.

2.

This Division ceases to apply to all members on 30 June 2014.

3.5.132  Members this Division does not apply to

 

A member in any of the following circumstances is not eligible to apply for bonuses under this Division.

 

a.

The member is serving an initial minimum period of service (IMPS).

 

b.

The member has been selected for promotion to a rank not listed in paragraph 3.5.131.1.b.

 

c.

The member has been selected to commission as an officer.

Exception: A member who has been selected to commission as an Aircrewman officer.

 

d.

The member is serving a period of undertaking for further service, under Part 8 of the Military Superannuation and Benefits Act 1991, as preserved by item 4 of Schedule 4 Defence Legislation Amendment Act (No. 1) 2005.

 

e.

The member is serving a period of undertaking for further service associated with either of the following bonus schemes. 

 

i.

Defence Determination 1998/7.

 

ii.

Defence Determination 1996/42.

 

f.

The member first meets the conditions for eligibility under subclause 3.5.131.1 after 30 June 2011.

 

g.

A member who is excluded by clause 3.5.133.

h.

A member who is in an employment category for which aircrew capability allowance may be payable may not join the scheme on or after 1 October 2009.

3.5.133  Members with less than five years remaining service

1.

This clause sets out limits on a member's eligibility to join the scheme, if they have less than five years remaining service in the Permanent Navy.

Examples:

1. A member's compulsory retirement age is due within five years.

2. A member's fixed period of service runs out within five years.

2.

A member may apply to extend their current period of service or their compulsory retirement age, in conjunction with their application to join the scheme.

Example: A member with three years remaining service wants to join the scheme for five years. The member applies to extend their period of service by an extra two years.

3.

The following table shows how a member with less than five years of remaining service is eligible to join the scheme.

Exception: A member may not specify a period in their application that will end after 30 June 2014.

3.5.134  Applications to join the scheme

1.

A member may apply to join the bonus scheme.

 

2.

The member must specify in their application whether they are committing to serve under this Division for three, four or five years.

Exception: A member may not specify a period that will end after 30 June 2014.

3.

An application must meet the requirements of subclause 4 or subclause 5.

 

4.

An application made under this subclause must be on the application form at Parts A to D of Annex 3.5.P.

An application made under this subclause must meet all the following requirements.

 

 

a.

The application is lodged by signal, facsimile or email message.

 

 

b.

A member may only join the scheme once.

3.5.135  Acceptance

1.

The CDF may accept an eligible member's application.

 

a.

The acceptance must be in writing.

 

b.

The acceptance must state the number of years in the member's service period.

2.

A member may not be accepted into the scheme after 1 July 2011.

3.

A member whose application has been accepted is taken to have undertaken to serve from the relevant date in the following table.

3.5.136  Obligation payment

1.

A member whose application for the completion bonus scheme is accepted is to be paid an obligation payment.

2.

The amount of obligation payment is determined in the following table.

3.5.137  Completion bonus

1.

A member who meets both the following conditions is entitled to a $35,000 completion bonus.

 

a.

The member has completed their service period under this Division.

 

b.

The period is all effective service.

2.

A member who meets both the following conditions is entitled to a portion of the completion bonus, calculated using the method in clause 3.5.140.

a.

The member has completed their service period under this Division.

 

b.

The service period includes ineffective service.

 

Related Information: Clause 3.5.138, Extension of the period for payment, allows a member with ineffective service to elect to serve for a longer period.

3.5.138  Extension of the period for payment

1.

A member may elect to serve for longer than their service period, if they meet both of the following conditions.

 

a.

The member has completed their service period under this Division.

 

b.

The service period includes ineffective service.

2.

An election under subclause 1 must have these features.

 

a.

The election must be on the form at Part E of Annex 3.5.P.

b.

The election may only be for a period ending on the day the member has served the number of years in the member's original service period under this Division.

Exception: A member may not elect to serve under this Division beyond 1 July 2014.

Example: A member elects to serve for four years. In that four-year period the member has 63 days that were not effective service. The member elects to extend his service period by 63 days, to make a total of four years of effective service.

3.

If a member makes an election, clause 3.5.137 ceases to apply to the member.

4.

A member who makes an election under subclause 1, and who serves for long enough to make up their original service period, is entitled to a $35,000 completion bonus.

Example: A member agreed to serve for three years. In that period the member has 50 days of leave without pay. The member elects to serve for longer, and works for an extra 50 days. The member is entitled to a $35,000 completion bonus.

5.

A member who makes an election under subclause 1, and who cannot serve enough to complete their original service period, is entitled to a bonus calculated using the method in clause 3.5.140.

Example: A member agreed to serve for three years. In that period the member has 50 days of leave without pay. The member elects to serve for longer, and but can only work an additional 20 days before their fixed period of service ends. The member's bonus is calculated under clause 3.5.140.

3.5.138A Election to leave the scheme

1.

This clause applies to a member who meets all the following conditions.

 

a.

The member is a qualified Navy Pilot or qualified Navy Maritime Aviation Warfare Officer.

 

b.

The member holds the rank of Lieutenant or Lieutenant Commander.

2.

The member may elect to leave the scheme before they complete their service commitment. The election must be in writing.

3.5.139  Bonus payable when member leaves the scheme

1.

A member who meets any of the following conditions before they complete their service period under this Division is not eligible for the bonus.

 

a.

The member voluntarily changes from a Pilot primary qualification.

 

b.

The member voluntarily changes from an Maritime Aviation Warfare Officer.

 

c.

The member voluntarily changes from an Aircrewman officer.

 

d.

The member voluntarily transfers out of the Aircrewman employment category, mentioned in Schedule B.11 Part 1 of DFRT Determination No. 15 of 2008, Salaries.

 

e.

The member initiates a transfer to the Reserves, under Regulation 56 of the Defence (Personnel) Regulations 2002.

Example: A member applies to the Chief of Navy to join the Reserves.  The member's application is granted. The member leaves the bonus scheme, and is not eligible for a completion bonus.

f.

The member resigns.

2.

A member who has been accepted into the bonus scheme under this Division is eligible for a pro rata bonus if their service under this Division ceases for one of the reasons described in the table.

2.

Category or specialisa-tion

 

a. The member transfers out of the Aircrewman employment category.

 

Exception: A member who voluntarily transfers out of category.

3.

Flying service

a. The member no longer holds an aviation qualification, as prescribed in Determination No 4 of 2006, Flying and flight duties allowance.

b. The member is permanently medically unfit for flying duties.

 

 

 

c. The member is not liable to fly.

4.

Rank

a. The member is reduced to the rank of Able Seaman or Seaman.

 

 

 

b. The member is promoted to the rank of Commander.

 

 

 

c. The member is commissioned as an officer.

 

Exception: A member who is commissioned as an Aircrewman officer may stay in the scheme. The member is not entitled to a pro rata bonus.

5.

MSBS

The member commences to serve an undertaking for further service under

Part 8 of the Military Superannuation and Benefits Act 1991, as preserved by item 4 of Schedule 4 of the Defence Legislation Amendment Act (No. 1) 2005.

 

6.

End of scheme

The bonus scheme ends.

 

3.

A pro rata bonus paid under subclause 2 is calculated using the method in clause 3.5.140.

This table shows how to calculate an amount of completion bonus that a member is entitled to under this Division.

Exceptions: Subclauses 3.5.137.1 and 3.5.138.4 provide for a completion bonus to members who complete their service period under this Division.

Example: A member sends a signal to join the scheme on 15 October 2007. The member joins the scheme for four years. On 1 December 2008 the member's service is terminated as the member is medically unfit. The member had 25 days of leave without pay in December 2007.

3.5.140A Aircrew supplement

1.

This clause applies to a member who meets all the following conditions.

 

a.

The member has joined the bonus scheme.

 

b.

The member is serving the period they committed to serve.

 

c.

The member holds the rank of Lieutenant or Lieutenant Commander.

 

d.

The member is a qualified Navy Pilot or a qualified Navy Maritime Aviation Warfare Officer.

Exception: An aviation specialist, placed in the structure set out under DFRT Determination No. 5 of 2009, Officer Aviation Specialist Structure

 

e.

The member is in an employment category with any of the following classifications, as described in Part 2 of Schedule B.2 of DFRT Determination No. 15 of 2008, as amended.

 

i.

Fly 0-2 (including Fly 0-2 under training).

 

ii.

Fly 2-4 (including Fly 2-4 under training).

 

iii.

Fly 4-6 (including Fly 4-6 under training).

 

iv.

Fly 6-8 (including Fly 6-8 under training).

 

v.

Fly 8-10 (including Fly 8-10 under training).

 

vi.

Fly 10+.

 

Exception: A member who has been issued with a notice of termination of service on disciplinary grounds.

2.

The member may be entitled to additional payments under the scheme, calculated in accordance with subclauses 4 and 5.

3.

The payments are due on each of the following dates.

 

a.

5.

A member in either of the following situations is to be paid a pro rata amount, calculated using the rates in subclause 4.

 

a.

The member had ineffective service during the six months before a payment date.

 

b.

The member has changed rank between Lieutenant and Lieutenant Commander during the six months before a payment date.

3.5.141  Administration of payment

1.

A member may nominate payment details for the completion bonus and obligation payment, subject to these conditions.

 

a.

The form must be completed before the day the payment is due.

 

b.

The nomination must be on the form at Annex 3.5.P.

If a member does not nominate payment details in the form at Annex 3.5.P, the obligation payment and completion bonus may only be paid into the member's normal pay account.
