12.5.1    Purpose

 

The purpose of this Part is to outline the conditions of service for employees on a contract of employment with the UN or other multi-national force.

12.5.2    Definition

Definition in this Chapter

Multi-national force

Multi-national force means any force led by a nation other than Australia. It includes elements of the armed forces of several nations, whether or not that force is acting under a resolution of the UN.

12.5.3    Employee this Part applies to

 

This Part applies to an APS employee who is granted leave without pay for employment with the UN or other multi-national force.

12.5.4    Employment with the UN

 

The Secretary may approve an employee to take leave without pay for employment with the UN or other multi-national force. This is to perform services for a specified period at an overseas location. The Secretary must consider all these criteria.

 

a.

Australia’s obligations to the UN or other multi-national force.

 

b.

The interests and effectiveness of the Department of Defence.

 

c.

The employee's interests and likely career progression.

 

d.

Any other factor relevant to the employment.

 

Persons who can make the decision under clause 12.5.4 on behalf of the Secretary:

A person not below MAJGEN(E)/SES Band 2 who is a Group Head

Director General Personnel Policy and Employment Conditions

12.5.5    Allowances and entitlements not payable

 

Except as set out in this Part, an employee on contract and their dependants have no entitlement under Chapters 12 to 17. This applies for all these periods.

 

a.

The period of the contract.

 

b.

Any period immediately before or after the period of the contract, in relation to the following.

 

i.

Conditions of service for long-term posting overseas.

 

ii.

Travel costs or any other costs incurred by the employee or a dependant in connection with the contract.

12.5.6    Entitlements in special circumstances

1.

The Secretary may approve conditions of service to apply to an employee during employment. The Secretary must consider all these criteria.

 

a.

The overall level of remuneration during the period of employment, including assistance provided for any similar entitlement.

 

b.

The costs incurred by the employee and dependants in relation to an entitlement.

 

c.

Any other factor relevant to the employee's circumstances during the approved period of the employment.

2.

The Secretary may approve the following conditions of service under this Determination, as if the employee were on a long-term posting at the employment location.

 

a.

Storage within Australia of the possessions of the employee and dependants at Commonwealth expense, while the member is on the contract.

 

b.

Insurance of personal effects and possessions of the employee and dependants, while the member is on the contract.

 

c.

Provision of residential accommodation for the employee and any dependants.

 

d.

If paragraph c. applies, the rent and utilities contribution payable by the employee.

 

e.

Meals supplement during a period of settling in or settling out at the employment location.

 

f.

Outlay advance.

 

g.

Assistance with health services provided overseas for the employee and any dependants.

 

h.

Reimbursement of costs to search for, secure and retain the employee's residential accommodation.

 

i.

Reimbursement of property taxes or other payments made, to enter an agreement for the dwelling occupied by the employee.

 

j.

Reimbursement of utilities costs.

 

k.

Household help.

 

l.

Any particular conditions of service specified for the employment location.
