12.4.1    Purpose

 

The purpose of this Part is to outline the conditions of service for members on a contract of employment with the UN or other multi-national force.

12.4.2    Definition

Definition in this Chapter

Multi-national force

Multi-national force means any force led by a nation other than Australia. It includes elements of the armed forces of several nations, whether or not that force is acting under a resolution of the UN.

12.4.3    Member this Part applies to

 

This Part applies to a member working overseas on a contract of employment (approved by the CDF) with the UN or other multi-national force.

12.4.4    Member on contract with the UN

 

The CDF may approve a member to enter a contract with the UN or other multi-national force. This is to perform services for a specified period at an overseas location. The CDF must consider all these criteria.

 

a.

Australia’s obligations to the UN or other multi-national force.

 

b.

The interests and operational capability of the ADF.

 

c.

The member’s interests and likely career progression.

 

d.

Any other factor relevant to the contract.

 

Persons who can make the decision under clause 12.4.4 on behalf of the CDF:

Director General Navy Personnel and Training

Commander Australian Navy Systems Command

Director General Personnel – Army

Director General Personnel – Air Force

12.4.5    Allowances and entitlements not payable

 

Except as set out in this Part, a member on contract and their dependants have no entitlement under Chapters 1 to 17. This applies for all these periods.

 

a.

The period of the contract.

 

b.

Any period immediately before or after the period of the contract, in relation to the following.

 

i.

Conditions of service for long-term posting overseas.

 

ii.

Travel costs or any other costs incurred by the member or a dependant in connection with the contract.

12.4.6    Period of contract counts as service

 

The approved period of the contract counts as service for salary advancement and accrual of service for long service leave.

12.4.7    Entitlements in special circumstances

1.

The CDF may approve conditions of service to apply to a member on contract. The CDF must consider all these criteria.

 

a.

The level of assistance provided for any similar entitlement under the member’s contract.

 

b.

The costs incurred by the member and dependants in relation to an entitlement.

 

c.

Any other factor relevant to the member’s circumstances during the approved period of the contract.

2.

The CDF may approve the following conditions of service under Chapters 14 and 15, as if the member were on a long-term posting at the contract location.

 

a.

Storage within Australia of the possessions of the member and dependants at Commonwealth expense, while the member is on the contract.

b.

Insurance of personal effects and possessions of the member and dependants, while the member is on the contract.

c.

Provision of residential accommodation for the member and any dependants.

d.

If paragraph c applies, the rent and utilities contribution payable by the member.

Assistance with health services provided overseas for a dependant of the member.

Reimbursement of property taxes or other payments made, to enter an agreement for the dwelling occupied by the member.
