Following on from the Defence Force Remuneration Tribunal (DFRT) decision on Phase 1 the ADF prepared a proposal to the Minister of Defence to make the Qualification and Skill (Q&S) elements of:
part of the member’s salary for the calculation of superannuation (whilst in receipt of the Q&S element).
On 01 March 2004 the Government endorsed this proposal and the ADF sought approval for the necessary amendments to the regulations of the DFRDB Act and the MSBS Board Rules. The definition of salary for each of the Superannuation Schemes had to be amended to include these payments as salary for the calculation of superannuation benefits.
The agreement of the MSBS Board was received on 14 May 2004 and that of the Federal Executive Council (DFRDB) on 24 June 2004. The changes were then gazetted on 1 July 2004 by the Office of Legislative Drafting to give effect to the changes for both MSBS and DFRDB schemes.
