SENATE ORDER ON DEPARTMENTAL AND AGENCY CONTRACTS
The Senate Order on Departmental and Agency Contracts (last amended March 2007) requires all Financial Management and Accountability Act 1997 (FMA Act) agencies to place on their internet websites information in relation to each agency’s contracts and their use of commercial-in-confidence provisions in contracts.
Defence and DMO are pleased to provide a list of contracts valued at $100,000 or more in satisfaction of the requirements of the Senate Order.
The list for calendar year 2011 includes 7,523 Defence and DMO contracts valued at $100,000 or more for each project (3,903 for Defence and 3,620 for DMO). The lists exclude contracts that that have been exempted from being reported under the FOI Act.
Commercial-in-Confidence Information

The Commonwealth Procurement Guidelines (December 2008) state that agencies should “consider, on a case-by-case basis, any request by a potential supplier for material to be treated confidentially” after the award of a contract. The DMO term ‘commercial-in-confidence’ has the same meaning as ‘confidential information’ that is used frequently by Defence, DMO and other government agencies, parliament and the courts.
Cost of Compliance with the Senate Order
The estimated cost of compliance with Senate Order 192 for calendar year 2011 contract listings for Defence is $8,694 and for DMO is $8,064. The estimated cost of compliance has been calculated using an estimate of labour hours expended by Defence and DMO staff across the portfolio to compile the listings.

Defence Contracts Gazetted Prior to 2003
Prior to the implementation of the IDCR, Defence addressed the Senate Order requirements by publishing lists of contracts gazetted by the Department valued at or over $100,000 during the reporting period. Each of these listings provides the name of the contractor, contract number, contract date, value of the contract and subject matter. Due to the operation of the Defence financial management system, in this context ‘contracts’ refers to purchase orders and amendments to purchase orders notified in the Commonwealth (Purchasing and Disposals) Gazette and, from 1 January 2005, in AusTender.

Parliamentary Access to Defence Contracts
Should the Parliament or one of its Committees seek to examine any contract listed in the attached list, Defence or DMO will release the information as requested. In complying with such a request, Defence or DMO would inform the requesting body of any confidentiality provisions and continuing claims of confidentiality associated with the contract and would request that these provisions be treated appropriately.
