Exposure Draft ASDEFCON (Support) V3.0

ASDEFCON (Support) is designed for the provision of in-service support services for Defence materiel capabilities. ASDEFCON (Support) has been developed for use in Maritime, Land, Aerospace and Electronic support environments.

Version 3.0 contains significant changes, notably it integrates a full Productivity and Performance-Based Contracting (PPBC) approach into the template.

Performance-Based Contracts are structured to motivate the supplier to achieve required outcomes, rather than merely achieving specified levels of transactions. The PPBC productivity component motivates both the supplier and the Commonwealth to reduce the Total Cost of Ownership (TCO) by achieving greater efficiencies in support of a capability system.

Template users are requested to provide feedback against V3.0. Your comments will be considered in the final release version and should be forwarded to commercial.innovationandpractice@defence.gov.au.

Key PPBC concepts in ASDEFCON (Support) V3.0 include:

  • performance payments linked to Key Performance Indicators (KPIs);
  • performance and efficiency linked to Award Terms;
  • new Substituted Performance clause;
  • new Change of Control clause;
  • reduction of scope and withdrawal of products from service provisions; and
  • ‘Off Ramp’ provisions to ensure smooth withdrawal of products from service or transition to a new contractor at expiry of the Contract.

In addition to PPBC changes, ASDEFCON (Support) Version 3.0 reflects the following changes:

  • mandatory procurement procedure options have been deleted from the conditions of tender – this reflects that V3.0 is focused on Strategic procurements only and that an ASDEFCON (Support Short) template to cater for Complex support procurements is under development;
  • removal of liquidated damages from Australian Industry Capability clause;
  • incorporation, where relevant, of all DPPIs up to DPPI 9/2011; and
  • updated clauses on Synthetic Greenhouse Gases and Dangerous Goods.

In addition, minor typographical and grammatical changes have been made, along with updated weblinks and references.

ASDEFCON (Support) Version 3.0 will only be available electronically on both the Defence Intranet and Internet sites.

ASDEFCON (Support) is structured as follows:

  • Preliminary pages, including: Cover Page, Amendment Certificate, Foreword and General Information for Users and Covering Letter;
  • Part 1: Conditions of Tender, TDRL and Annexes to the TDRL;
  • Part 2: Draft Conditions of Contract, including Attachments; and
  • Part 3: Draft Statement of Work, including Annexes.

Template users should note the ASDEFCON (Support) Asset Library which should be used in conjunction with the template. The Asset Library consists of Data Item Descriptions (DIDs) and Detailed Services Descriptions (DSDs). In addition, template users should note the GFF Licence which may be required to be used in conjunction with the template.

The following supplementary DIDs are referenced from the Contract Data Requirement List (CDRL) at Annex C to the Statement of Work (SOW). The SOW Tailoring Guide also refers to them. Further understanding of these DIDs can be gained by reviewing the Defence Training Model (ADFP 7.0.2). Note that DID-ILS-TNG-TNGMP not only requires the completed Training Management Package, but also supporting development documentation.
