ASDEFCON (Standing Offer for Goods) V2.3
Effective July 2010
ASDEFCON (Standing Offer for Goods) is for use when establishing a standing offer arrangement with a supplier or a panel of suppliers for low value, low risk procurements of goods up to an aggregate value of $5 million. Standing offer arrangements are appropriate where the Commonwealth has an ongoing requirement for commercial-off-the-shelf supplies to be delivered on an ‘as required’ basis.
Version 2.3 reflects updates in Commonwealth policy affecting the ASDEFCON (Standing Offer for Goods) template. Changes include:
- new Public Announcement clause;
- updated Australian Industry Capability requirements;
- updated Defence Security requirements to align with the new electronic Defence Security Manual;
- updated Policy Requirements clauses to reflect policy changes;
- updated OHS clauses to align with changes to Commonwealth OHS legislation;
- new clauses to capture the obligations imposed by the Fair Work Principles;
- new AusTender Level 2 clauses;
- new Environmental Obligations and Compliance with Laws clauses to align with higher-level ASDEFCON templates; and
- new Limitation of Liability and Intellectual Property Indemnity clauses.
In addition, minor typographical and grammatical changes have been made, along with updated weblinks and references. The template has also been formatted with the new DMO Style Set developed specifically to assist with document stability of the ASDEFCON templates.
While the template is designed to be tailorable with respect to the length of the standing offer period, it has been drafted on the basis that each standing offer would generally be in place for three years, with an option for two additional 12-month extensions.
