5. I am moving from another APS Agency to Defence. Can I transfer my personal leave?

Personal leave credits accrued or deemed to have accrued during eligible prior employment with another APS agency (as defined by the Public Service Act 1999);  the Parliamentary Service (as defined by the Parliamentary Service Act 1999); or the ACT Government Service will be carried over provided there is no break between finishing that employment and starting with Defence.  The Australian Public Service Commission site includes a list of agencies that engage employees under the Public Service Act.

Organisations such as CSIRO, Australian Government Solicitor and Air Services Australia which come under the Commonwealth Authorities and Companies Act 1997 (CAC Act), are not APS agencies and employees are not engaged under the Public Service Act.  Unused personal leave credits from these organisations are not able to be transferred to Defence.  The Department of Finance and Deregulation site includes a list of organisations that come under the CAC Act.

All Defence’s accrual arrangements for personal leave are based on the specifications in Defence’s collective agreement.
