ADF Member's Guide

Compensation for loss of or damage to items stored or removed

You may get reimbursed for loss of or damage to furniture and effects removed or stored at Defence expense. Items will usually be repaired if it is reasonable or economical.

What are furniture and effects?

Furniture and effects are all the household items you usually have and use. They can be easily removed.

Who can get reimbursed for loss of or damage to furniture and effects?

You may get reimbursed for loss or damage if you are a:

  • member of the Permanent Forces
  • member of the Reserves on continuous full-time service
  • dependant, or
  • legal personal representative of a member.

When can I get reimbursed for loss of or damage to furniture and effects?

You may get reimbursed for loss of or damage to furniture or effects if:

  • your removal was within Australia at Defence expense, and
  • your furniture or effects were stored at Defence expense.

When can't I get reimbursed for loss of or damage to furniture and effects?

You can't get reimbursed for loss of or damage to any of the following items removed or stored at Defence expense:

  • a private vehicle
  • a towable item
  • any item outside removal limits, or
  • opened containers of products.

You can't get reimbursed for damage to any item you packed yourself (packed by owner) that wasn't packed properly. You can choose to get insurance for the items you pack. Defence won’t reimburse you for any loss or damage to those items. However, you may get reimbursed if the removal carton was damaged during the Defence removal.

If you include any dangerous items, living items (animal or plant), bulk fuel or building items, you won't get reimbursed for loss of or damage to your furniture and effects.

How do I get a damaged item repaired or replaced?

A damaged item may be repaired unless it is beyond repair or not worth fixing.

Toll Transitions may decide it is economical and reasonable to repair an item.

You must agree to get an item repaired or replaced before any action is taken.

You may be reimbursed for the immediate repair of an item if:

  • it is essential
  • it is damaged
  • it can't be used, and
  • Defence approves the repair and chooses the repairer.

Toll Transitions may reimburse you for any loss or damage.

You may get short-term hire of an essential item until it is repaired or replaced.

If an item can't be repaired, it may be replaced with or reimbursed as a new or like item. This depends on the item's type and age.

If the item is one of a pair or collection, only the damaged item can be reimbursed. If a set doesn't work without the damaged item, you may be reimbursed for the set.

You may not get reimbursed if you repair, replace, throw away, or continue to use or own an item.

If you are reimbursed for a lost or damaged item and then sell it, you must repay Defence.

What happens if I need household items urgently?

You may get urgently required household items moved at Defence expense.

If you insure these items, you may get the cost of insurance reimbursed. If you die, your dependant may be reimbursed.

When can I ask for a review of decision on reimbursement?

You may ask for a review of decision if:

  • Toll Transitions has refused your claim for loss or damage, or
  • you aren't satisfied with the outcome of negotiations with Toll Transitions.

You may also request your claim be forwarded for a national review. You must provide additional information to support your claim.

More information about compensation for loss or damage to items stored or removed can be found in Chapter 6 Part 4.
