Part 2: Hardship allowance – member posted before 1 July 2017

16.2.1 Purpose

Hardship allowance assists members and their dependants with the difficult conditions that may be encountered at a hardship location.

16.2.2 Member this Part applies to

  1. This Part applies to a member posted before 1 July 2017 to a hardship location.

  2. See: Chapter 12 Part 3 section 12.3.9A for the definition of Member posted before 1 July 2017

  3. When a member leaves a long-term hardship posting location with a period of leave credit that accrued while the member was at the location, the CDF may authorise a payment of hardship allowance. This payment is made in the same manner that overseas living allowances are paid when the member takes that period of leave.

Persons who can make the decision under subsection 16.2.2.2 on behalf of the CDF:
A person working in the Pay an Administration Centre – Victoria who is authorised to manage Defence pay administration at overseas posts and is not below WO2(E)/APS 5.

16.2.3 Member this Part does not apply to

This part does not apply to a member for a period when any of the following conditions apply to the member.

  1. They are not entitled to salary.

  2. They are absent from a hardship location, except as provided in section 16.2.8.

16.2.4 Payment of hardship allowance

  1. This section applies to a member who has performed duty in a hardship location for 28 or more continuous days.

  2. Exception: The CDF may reduce this period to less than 28 days.

    Note: Section 16.1.9 applies.

  3. Subsection 1 applies to each long-term posting overseas or period of short-term duty.

  4. Exception: The member meets both of the following.

    1. The member has satisfied the 28 days period in subsection 1.

    2. The member's long-term posting overseas or short-term duty overseas to a hardship location begins immediately after the period of duty under paragraph a. is satisfied.

  5. The member is paid hardship allowance from the day they commenced duty in a hardship location.

  6. Subject to subsection 16.2.6, payment of the allowance ceases on one of the following dates.

    1. For a member on a long-term posting overseas — the date the member's posting period overseas ends.

    2. For a member on a short-term duty overseas — the day the member leaves the location.

  7. The dual Commonwealth benefit rule applies to this allowance.

16.2.5 Rate of allowance

  1. Subject to section 16.2.7, the member is paid the rate for the grade of the location in which they are performing duty and their status as an unaccompanied or accompanied member. The rates are set out in the following table.

  3. Hardship allowance is paid fortnightly on a pro rata basis using the calculation provided under section 3.2.7.

16.2.6 Absence from location

This table shows the hardship allowance payable when a member is temporarily absent from the location for short-term duty overseas or recreation leave.

1. is on a long-term posting overseas hardship allowance for the first 28 days of a temporary absence then no hardship allowance for the remaining period of the absence.
2. is on short-term duty overseas no hardship allowance for the period of the absence.
Exception: The member is on short-term duty in a hardship location.
3. has dependants remaining at the location while they are absent hardship allowance despite the member being absent from the hardship location.

16.2.7 Duty in another hardship location

  1. This section applies to a member who receives hardship allowance immediately prior to beginning short-term duty ('the member's previous location') in another hardship location.

  2. If the short-term duty location has a higher hardship grade than the member's previous hardship location — the hardship allowance is payable at the rate for the grade of the location of the short-term duty.

  3. If the short-term duty location has a lower hardship grade than the member's previous hardship location — the hardship allowance is payable at the rate for the grade of the member's previous hardship location.

Application to Reservists: Yes, on continuous full-time service.
