Instruments of Delegation

Minister's Instrument of Delegation

  1. The Minister for Defence's Instrument of Delegation under section 58E of the Defence Act 1903 gives power to make Defence Determinations under section 58B of the Act.

  2. The Instrument sets out who may exercise the Minister's powers and under what conditions.

Assistant Minister's Instruments of Delegation

  1. The Assistant Minister for Defence has made the following two Instruments of Delegation.

    1. Delegation of powers and functions contained in section 30 of the Military Superannuation and Benefits Act 1991.

    2. Delegation of powers and functions contained in sections 52 and 53 of the Defence Home Owners Assistance Scheme Act 2008.
